General Contract and Travel Conditions for Accommodation at “Villa Ottilienruh & Landh\u00e4user”, Punierstra\u00dfe 23 in 38871 Ilsenburg \/ Harz, of Ilsetal GmbH & Co. KG<\/strong><\/p>

<\/strong><\/p>

  1. Conclusion of the Contract<\/strong><\/li><\/ol>

    By submitting an online inquiry or an inquiry via email, the guest makes a binding offer to Ilsetal GmbH & Co KG (hereinafter referred to as: the Lessor) to conclude a contract. The registration is made by the registrant\/booker, also on behalf of all listed travel participants, for whose contractual obligations the registrant\/booker is liable as for their own obligations. If a third party has made a booking for a guest, they are jointly and severally liable with the guest to the Lessor. The contract is concluded upon the acceptance of the respective rental offer for the suite or country house by the registrant\/booker for the corresponding number of persons. The rental price offer for the suite, including breakfast, or the country house (breakfast can be booked upon request), includes final cleaning and ancillary costs.<\/p>

    If the content of the reservation confirmation deviates from the content of the inquiry\/registration, the deviating content of the confirmation becomes binding for the guest and the Villa if confirmed in writing.<\/p>

    To finalize the reservation for the guest, the Lessor requests a 25% down payment of the booking value to the business account of Ilsetal GmbH & Co. KG, IBAN DE88 8105 2000 0901 0737 92 at Harzsparkasse. After successful receipt of payment, the registrant\/booker will receive a booking and payment confirmation from the Lessor. If the guest cancels after the booking confirmation, they are not entitled to a refund of the down payment. Cancellations must always be made in writing. The remaining balance of the total price must be paid to the aforementioned account no later than 30 days before arrival, for which the guest will also receive a payment confirmation. If the guest cancels within 30 days before the arrival date, they shall bear the full cost of the rental price as per the contract.<\/p>

    In case of non-utilization, the guest is also obliged to pay the full rental price as per the contract.<\/p>

    1. Granting of Use<\/strong><\/li><\/ol>

      The suite or country house will be provided to the guest in a clean and well-maintained condition for the period specified in the written booking confirmation.<\/p>

      Use is permitted only for the agreed number of persons as per the agreement. Subletting is not permitted. The beds are freshly made for the number of guests, and each guest receives a clean hand and bath towel from the Lessor.<\/p>

      The guest is obliged to treat the suite or country house and its furnishings with care and to return them properly and broom-clean. The guest will be held liable for any damages incurred, even if discovered after the guest’s departure. The place of performance is Ilsenburg, and the place of jurisdiction is Wernigerode.<\/p>

      1. Arrival and Departure<\/strong><\/li><\/ol>

        The registrant will receive a “Bon Voyage” email from the Lessor approximately 3 days before their trip, containing further information and a link for early check-in. Should you encounter any issues with this, please send us your postal address, as well as the first and last names with dates of birth of all travel participants, via email for the issuance of your spa visitor’s cards within the registration system.<\/p>

        <\/strong><\/p>

        Key handover to the guest will be carried out by us or a team member in person, with an introduction, on the day of arrival between 3:00 PM and 5:00 PM.<\/p>

        Early Check-In:<\/strong> If you wish to arrive early and occupy your suite, we can arrange this for you, after prior consultation, from 1:00 PM for an additional charge of \u20ac40.<\/p>

        Please notify us in advance of your arrival at Tel. No. 039452\/86212 or Mobile No. 0157\/ 71277639, regarding your estimated time of arrival.<\/p>

        We kindly ask you to vacate your suite by 11:00 AM on the day of departure, or the country house by 10:00 AM. We will coordinate this again during the arrival formalities, or please contact us in good time using the aforementioned contact details.<\/p>

        Late Check-Out: <\/strong>If your accommodation is still available on your departure day, you can extend your stay until 1:00 PM for \u20ac40.<\/p>

        1. Dogs & Smoking<\/strong><\/li><\/ol>

          The accommodation of dogs in the suite or country house is only permitted with prior consent, and dogs must always be supervised by a person. The accommodation of a dog requires that it is well-behaved and house-trained. Appropriate dog accessories must be brought by the dog owner themselves.<\/p>

          Smoking of all substances, tobacco, and cannabis is prohibited in all suites and country houses. If smoke odor or an unregistered animal is detected in the accommodation, a basic cleaning fee of \u20ac200 will be charged.<\/p>

          1. Fiber Optic \/ Wi-Fi Internet Connection<\/strong><\/li><\/ol>

            Upon request, we provide you with a free Wi-Fi connection from Deutsche Telekom in our Villa Ottilienruh & Landh\u00e4user. The registrant\/booker assumes joint and several liability for themselves and all fellow travelers for the period of use. Should additional costs be incurred due to internet usage, these shall be borne exclusively by the guest and will be fully claimed.<\/p>

            The Lessor assumes no liability for the topicality, correctness, completeness, and quality of the information provided. Liability claims against the Lessor relating to material or immaterial damages caused by the use or non-use of the information provided or by the use of incorrect or incomplete information are fundamentally excluded.<\/p>

            The surfing speed depends on Deutsche Telekom. The Lessor assumes no responsibility\/liability for damages in this regard. Internet outages on the part of Telekom are not the responsibility of the Lessor and cannot be remedied on weekends and public holidays.<\/p>

            <\/strong><\/p>

            1. Liability<\/strong><\/li><\/ol>

              Should disruptions or defects occur in the services of the suite or country house, the Lessor will endeavor to remedy them upon immediate notification by the guest. Irrespective of \u00a7\u00a7 701 et seq. of the German Civil Code (BGB), the Lessor is only liable in cases of intent or gross negligence. Safekeeping requires explicit agreement. Offsetting, reduction, or withholding of payments by the guest is only permissible for undisputed or legally established counterclaims. Any liability of the Lessor \u2013 apart from \u00a7\u00a7 701 et seq. BGB \u2013 is limited to the amount of the agreed lodging price. The limitation period for all claims of the guest is 6 months. In cases of force majeure (e.g., fire, water damage, strike, etc.) or other impediments for which the Lessor is not responsible (e.g., reputational risk), particularly those outside the Lessor’s sphere of influence, the Lessor reserves the right to withdraw from the contract without the guest\/customer being entitled to claims for damages, for example. The guest is liable to the Lessor for damages or losses that occur during the contract period.<\/p>

              No further agreements are concluded between the contracting parties. Corresponding changes to the contract, additions, and extensions require written form to be valid.<\/p>
